Monitoring officer and legal: Issue a Section 5 report on unlawfulness or maladministration. Starts when: A proposal, decision or omission is likely to be unlawful or an ombudsman finds maladministration. Steps: Assess; Consult the head of paid service and chief finance officer; Send the report to every member; Council or cabinet considers within 21 days; Implementation paused. Done when: Every member receives the report and the meeting considers it within 21 days. Rules that apply: Local Government and Housing Act 1989 s5 and s5A.
